Do I need a Disability Lawyer?

Do I need a Disability Lawyer?

Do you suffer from an injury or disability that disrupts your ability to work or function properly? Social Security Disability Benefits are given to citizens who cannot work due to their illness or injury. Depending on where you are in the claims process, it may be time to hire a disability lawyer to get you the compensation you deserve.

What are disability benefits?

The Social Security Administration (SSA) offers financial benefits to the disabled if they qualify. There are two main programs for these benefits:

Social Security Disability Insurance (SSDI)

If you have worked and contributed to Social Security Taxes for long enough and have a condition that meets the Social Security’s definition of disability, you may qualify for these benefits. The number of work credits needed to qualify for SSDI benefits varies from year to year and depends on the age you become disabled.

Supplemental Security Income (SSI)

If you have a limited income and resources as a disabled citizen, you may be eligible for SSI. Unlike SSDI this is a need-based benefit that does not require previous work history.

What is the Social Security Administration’s definition of disability?

In order to be considered disabled by the SSA, you must meet specific requirements. First, your condition must be on the list of medical conditions considered substantial by the SSA. If it is not, you will have to prove that the condition is severe enough to deserve these benefits. You must also prove:

  • You are either not working or earn less than $1,220 a month.
  • Your condition limits your ability to perform basic work functions such as standing, walking, or remembering.
  • This illness or injury has prevented you from performing these functions for at least 12 months.
  • You cannot do the work you did previously or any other type of work due to your condition

My Social Security Disability Claim was Denied

The first step after you have been denied is to begin the appeal process. You will get a notice from the SSA in the mail that outlines the denial. It is important to read this carefully for the next steps. In most states, the next task is to file a request for reconsideration.
